Terms & Conditions of Ticket Purchase, Entry, and Liability

PLEASE READ CAREFULLY

THESE TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR WAIVER OF LIABILITY, YOUR ASSUMPTION OF RISK RELATED TO EXPOSURE TO COVID-19 OR ANY OTHER COMMUNICABLE DISEASE, YOUR WAIVER OF CLASS ACTION RIGHTS, AND YOUR AGREEMENT TO BINDING ARBITRATION.
BY PURCHASING A TICKET OR ENTERING THE PREMISES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

I. Ticket Policy and Admission

  1. All Sales Final:
    All tickets and packages are non-refundable. No refunds, credits, reimbursements, or exchanges will be issued for any reason, including but not limited to illness, weather, travel issues, dissatisfaction with the experience, or inability to attend.
  2. One-Time Ticket Change Policy:
    Guests may change their ticket
    one (1) time only to a different available date or time through our authorized third-party ticketing provider.
  • If the new date/time has a higher price, guests must pay the price difference.
  • If the new date/time has a lower price, no refund or credit will be issued.
  • After one change, no further changes or refunds may be made for any reason.
  1. Admission Requirements:
  • Each ticket admits one (1) person unless otherwise stated.
  • A valid, government-issued photo ID is required for all adult guests.
  • Entry may be refused at the discretion of the Organizer for any reason including intoxication, disorderly behavior, or violation of venue policies.
  • Re-entry is not permitted.
  1. Age Policy:
  • All ages allowed until 7pm.
  • After 7pm, the venue is 21+ only, no exceptions.
  • Guests who fail to meet age requirements or present valid ID after 7pm will not be admitted and will not receive a refund.

II. Assumption of Risk and Waiver of Liability (Including COVID-19 and Other Infectious Diseases)

  1. Assumption of Risk:
    Attendance at a public event involves inherent risks, including exposure to COVID-19, SARS-CoV-2, and other communicable or infectious diseases. These risks may result in illness, injury, or death. You voluntarily assume all risks associated with entering the venue and participating in the event.
  2. Waiver and Release:
    You, on behalf of yourself and your heirs, executors, administrators, and assigns, hereby waive, release, and discharge Holiday Pop Up Bars LLC, Nutcracker Pop Up Christmas Bar, its officers, directors, owners, employees, contractors, agents, affiliates, insurers, and successors (“Released Parties”) from any and all claims or damages arising from exposure to any communicable or infectious disease during or after attendance.
    This waiver applies to claims based on ordinary negligence to the fullest extent allowed by law.
  3. Tickets Purchased for Others:
    If you purchase tickets for or transfer tickets to other individuals, you confirm that all such individuals have independently reviewed and accepted these Terms, including this waiver.
  4. Indemnification:
    You agree to indemnify and hold harmless the Released Parties from all claims, losses, liabilities, and expenses (including attorneys’ fees) brought by any third party arising out of your attendance, conduct, or violation of these Terms.

III. Health and Safety Acknowledgment

Guests must comply with all venue rules, posted instructions, and any health or safety policies required by the City of Chicago or State of Illinois. The Organizer may deny entry or remove any guest who does not comply with safety requirements, with no refund issued.

IV. Conduct and Removal

Guests must behave responsibly and respectfully at all times. The Organizer may remove or refuse entry to any guest for reasons including but not limited to:

  • Intoxication or illegal substance use
  • Harassment, discrimination, or verbal/physical misconduct
  • Property damage or theft
  • Failure to follow staff instructions
  • Violation of these Terms or any applicable law

Removed guests will not receive a refund or credit.

V. Limitation of Liability

To the fullest extent permitted by law, the Released Parties are not liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from or related to attendance at the event or any activities on the premises, even if the possibility of such damages was disclosed.

VI. Binding Arbitration and Class Action Waiver

  1. Agreement to Arbitrate:
    Any dispute, claim, or controversy arising out of or relating to these Terms, your ticket purchase, or your attendance shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (AAA). Judgment on the arbitration award may be entered in any court with proper jurisdiction.
    Both parties waive the right to a trial by jury.
  2. Class Action Waiver:
    You agree that any claim must be filed
    individually and not as part of any class, collective, or representative action. No arbitration may be consolidated with another arbitration without written consent of all parties involved.
  3. Location and Governing Law:
    Arbitration will take place in Cook County, Illinois. These Terms are governed by the laws of the State of Illinois and the Federal Arbitration Act.
  4. Informal Resolution Requirement:
    Prior to initiating arbitration, the complaining party must send written notice describing the dispute to:

    Both parties agree to attempt informal resolution for sixty (60) days before initiating arbitration.

VII. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois and the City of Chicago. If arbitration is not initiated, lawsuits must be filed exclusively in the courts of Cook County, Illinois.

VIII. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

IX. Entire Agreement

These Terms constitute the entire agreement between you and Holiday Pop Up Bars LLC regarding ticket purchases and attendance at Nutcracker Pop Up Christmas Bar and supersede all prior agreements or representations.

X. Acknowledgment

By purchasing a ticket or entering the venue, you acknowledge that you have read, understood, and agree to all Terms and Conditions, including the waiver of liability, assumption of risk, arbitration agreement, and class action waiver.
